Mazin Sbaiti is a Founding Partner of Hutcherson Sbaiti LLP. His practice focuses primarily on helping and counseling clients in matters involving their critical business assets – specifically, their contract rights, intellectual property, and reputations. Mr. Sbaiti’s approach to trial strategy—trimming down the material issues and focusing aggressively on them—is unique among litigators, and has served Mr. Sbaiti well. He has successfully tried civil matters, large and small, before juries, judges and arbitrators, and has recovered in excess of $100 million on behalf of plaintiffs, and helped defendants avoid over $1 billion in liabilities.
Some significant representations include:
- Retained with one other attorney just months before trial, represented small bio-technology firm in a breach of contract and trade secret matter against Fortune 100 drug maker, reinvestigated matter and converted legal theory, while avoiding pending sanctions and discovery motions—obtained 8-figure cash settlement, more than five-times the prior offer, and obtained intellectual property rights worth $tens-of-millions to client.
- Defended massive German conglomerate in a Swiss arbitration against claims of over €1.4 billion for fraud, rescission and breach of M&A contract; co-drafted the primary brief which arbitrators held disposed of entire case, and lead to pre-appeal settlement for a nominal amount.
- Member of trial team on behalf of investment advisor seeking payment for services; recovered full amount (over $15 million) and defeated fraud counterclaims.
- Defended client software maker against claims for patent infringement totaling over $12 million—negotiated complete voluntary dismissal of claims against client, with no money or property paid by client.
- Represented high-level telecom products sales executive in pre-dispute negotiations regarding compensation owed—successfully negotiated six-figure payment package without filing suit.
- Represented Japanese chemical manufacture against suit by states attorneys general for claims of price fixing and anticompetitive behavior—successfully obtained dismissal of claims by NY attorney general (other claims left pending when I left the firm).
- Member of trial team representing major Swiss biotechnology firm against major U.S. competitor in antitrust monopolization claims in agriculture biotech field; matter eventually resolved favorably.
- Lead attorney in arbitration against distributor on behalf of client alleging breach of supply agreement; obtained damages and attorneys fees, and partial injunction.
- Lead attorney in several employment discrimination arbitrations against same client, successfully defended client against all claims.
- Member of trial team representing major telecom supplier in several securities, ERISA and derivative class actions; case eventually settled for fraction of amounts sought by class action.
Professional Background:
Prior to founding his own firm, Mr. Sbaiti worked at Susman Godfrey LLP, one of the country’s premier trial firms, where he handled massive litigations involving complex-commercial, antitrust, business-tort, securities, patent, and class action matters. Before that, Mr. Sbaiti clerked on the U.S. Court of Appeals for the Sixth Circuit. There, he was involved in over 100 appeals raising novel issues of federal and state law, and helped draft over 50 appellate opinions resolving the issues before they reached the U.S. Supreme Court.
Education:
Mr. Sbaiti received his Doctorate of Laws with honors from Columbia University’s School of Law in New York. There, he was recognized as a Harlan Fiske Stone Scholar for Academic Excellence; chaired the Moot Court Executive Board; served on the editorial board of the Columbia Human Rights Law Review; was a Research & Writing Editor for the First-Year Moot Court program; and coached the Columbia Mock Trial Team. Mr. Sbaiti graduated cum laude in philosophy from Emory University in Atlanta, Georgia, where he interned for President Jimmy Carter’s Center for public policy research, and was a member of the Barkley Forum, Emory’s debate society.
